What is the 2nd Amendment?
The 2nd Amendment is that part of the US Constitution which states:
"A well regulated Militia being necessary to the security of a free State,
the right of the people to keep and bear Arms shall not be infringed."
the right of the people to keep and bear Arms shall not be infringed."
Every elected federal and state official must swear an oath the US Constitution, and every elected official in the State of Georgia must also swear an oath to the Georgia Constitution, which includes the following paragraph:
"Article I, Section I, Paragraph VIII: Arms, right to keep and bear. The right of the people to keep and bear arms shall not be infringed, but the General Assembly shall have power to prescribe the manner in which arms may be borne."
This makes it clear that each and every elected federal and State of Georgia official, must act to PROTECT the Right to Keep and Bear Arms. Furthermore, since the power to regulate the keeping and bearing of arms is NOT delegated to the United States government, any and all attempts by the federal government to regulate the keeping or bearing of arms should be NULLFIED by the State of Georgia.
The Georgia Constitution is clear that the Georgia General Assembly has the power ONLY to prescribe the manner in which arms may be borne. Assuming that the Right to "keep" arms is the Right to have and to own weapons such as guns, it is clear that everyone can have, and own, and even bear, guns and other "arms" such as the term implies, but that the manner in which such arms may be borne or carried IS subject to regulation, not by the federal government, but only by the General Assembly of the State of Georgia.
This is understood by this candidate to mean that neither the United States government nor the State of Georgia government, nor anyone else for that matter, has the legal authority to prevent or place burdens or restrictions of any kind regarding the owning of, keeping of, and bearing or carrying of, guns and other "arms" as the terms implies, except that the Georgia General Assembly DOES have the authority to regulate how such "arms" may be borne in different circumstances, but not to the point of effectively preventing the bearing of such arms.
The existing Georgia Code should be reviewed to ensure that this Right to Keep and Bear Arms is secured and not infringed upon except by the Georgia General Assembly only in prescribing the manner in which such arms are borne or carried.
No quantity threshold nor degree of instances of unlawful use of such arms by any number of individuals should ever justify any attempt to infringe upon this sacred Right, either at the federal or state level, even in the event of, or especially in the event of, any act of terrorism, or any declared or undeclared emergency or exigency of any kind.
